AMD fails to stop S3 lawsuit against Apple

Towards the end of September this year S3 graphics who are a subsidiary of the VIA technology group took Apple to court (the irony) over charges of patent infringement (more irony) related to the graphics component of basically all Apple products (the afflicted products are the iPhone, iPad, iPod touch, and iMac.). VIA technology is soon to be bought by HTC when the takeover goes through.
AMD claims that they own the patents since they make graphics parts for Apple, it introduced a counter lawsuit but In an October 28 filing with the ITC (International Trade Commission), S3 says that a federal judge struck down a request for an immediate halt into S3’s case, but the Commission is scheduled to release its final decision on November 15. The case struck down was Advanced Micro Devices Inc. v. S3 Graphics Co., 11cv965, U.S. District Court for the District of Delaware (Wilmington). Which therefore means AMD was unsuccessful in trying to halt the action, the outcome of this case should be interesting, will Apple get beaten at its own game?
