In addition to Apple driving home their Galaxy Nexus ban in the U.S.A, it is also making the most of its win in the Galaxy Tab 10.1 patent case too. Even though Apple’s case against the Samsung Galaxy tab 10.1 was thrown out of court in the UK, they somehow managed a win over in the U.S.A. Apple have obtained a preliminary injunction against the sale of Galaxy Tab 10.1 in the U.S.A which they are now forcing upon retailers who are selling already-purchased Galaxy 10.1 tablets.
The preliminary injunction allows Apple to stop sales of the Galaxy 10.1 from Samsung’s “officers, directors, partners, agents, servants, employees, attorneys, subsidiaries, and those acting in concert with any of them,”. Now usually this would not mean retailers (as retailers are separate entities to both Apple and Samsung), but Apple is claiming that “those acting in concert with any of them” includes retailers too. So with the preliminary injunction, if Apple can get the last bit approved they can now force retailers to stop selling already purchased Samsung Galaxy 10.1 tablets.
What is very sad for everyone here, is if this goes through the only people that benefit is Apple, the losers are consumers and the entire tablet market. If Apple’s purge of the already purchased Galaxy 10.1 tablets is successful, then retailers will be left with a huge stockpile of expensive tablets they cannot sell. Even if the injunction is overturned, by the time it is the Galaxy 10.1 will probably be outdated and will have to be sold at a loss. Either way retailers will be stuck with a huge loss thanks to the greedy hand of Apple.
With retailers incurring losses, prices may have to rise as a result. While amidst all of these legal battles we think both Apple and Samsung have lost sight of the consumers and its about time they worked out a fair settlement so the market can move on with innovation without having to fear legal proceedings around every corner of product development.
