Sometimes smartphone vendors do things we don’t like – for instance they might release an update that causes more problems than it fixes or they might just stop releasing updates for old handsets which annoys people who don’t want to be forced to upgrade to gain access to the latest software features of their mobile OS. In the case of Apple their iOS 7 was a bit of a mixed bag because it brought a tonne of new features and improvements for iOS users but at the same time some old iPhones (such as the iPhone 4) saw noticeable drops in performance and battery life – many old iPhone users labelled their “newly updated” iPhones as unusable.
CNET reports that an iPhone user was so annoyed by the automatic iOS 7 update on his handset that he is now taking small claims legal action against Apple through the Superior Court of California in San Diego. Mark Menacher from Poway, California, is demanding that Apple remove the iOS 7 update from his phone and pay him $50 compensation despite the fact Apple doesn’t officially support iOS “downgrades”. Mark Menacher is also apparently investigating whether his case can be elevated to a class action lawsuit level.
“Apple’s disregard for customer preferences in relation to iOS7 is corporate thuggery. Steve Jobs was reportedly rough on company employees in pursuit of happy customers, but Tim Cook apparently cultivates a culture of contempt for customer satisfaction in pursuit of corporate profits. It is a policy that will eventually fail.” Stated Mark Menacher.

Automatic update? That’s funny, I had to confirm two different prompts before it installed on mine. God damned americans, suing over EVERYTHING.
All they will tell him is if he didn’t have Automatic Updates switched on, then he wouldn’t be having these issues. So yet again, it comes down to Dumb Users.

I can see with your over generalization of Americans that you are an idiot. What happens if you update and it’s shit? Should you be made to keep it? That’s this guys argument. He’s not suing for a lot of money, rather he’s making a point. I’ve been an apple employee for years and I hate iOS 7. I’m jail breaking this phone and going back to 6. I’ve owned every iPhone so far, and iOS 7 has ruined my opinion about the phone and company. If I want a shorter battery life and apps continuously running, I’ll go to an android.
I agree with you, but an awful lot of Americans like suing companies for their personal mistakes, although this man should have the option to downgrade for free if he wishes :/
Unfortunately suing is the only option to have your voice heard sometimes :/ I too hate the ridiculous lawsuits that people file- most I laugh at, but he is making a valid point with his argument. I just wish others could see that. Also, it’s affecting new phones too, and not just the 4 or older. So many complaints!
Yep, some are so ridiculous that you just have to laugh 😛 I have never really loved apple products myself, I have always had the iPods (Nano, shuffle, touch etc) because it is really the best option out there and has been for a long time, but Apple seem to be losing sight of their customers, the ones that actually get them the profits they so desire -_- I tend to buy products from ‘nice’ companies and so Apple have slowly lost my respect with these sorts of stories about customer service etc… :/

I almost wonder if there will be a class action law suit. As someone that works for AT&T, I’ve personally gotten complaints regarding the iOS 7 update, especially in regards to the update on the 4/S models. Mostly to the fact that it breaks WiFi, from completely not working, or not saving the login information. It’s frustrating because there is nothing that can be done about it.
where did the update say it wasn’t compatible with Iphone 4 or 4s hardware, and that the update would f**k up your phone.
iOS 7 is an abomination and I’m sure Steve jobs is rolling in his grave as thousands of people switch to samsung over design flaws. Even the music app is almost useless now with its non user friendly interface. Sad that being a music player was originally how I iPods came to be so popular and now it’s one of its worst features. You blew it apple…big time
